Terms of Sale

1. Introduction

These Terms of Sale ("Terms") govern the sale of goods and services by Specialised Steering (Pty) Ltd ("we", "our", or "us") to you ("Customer", "you", or "your"). By placing an order or engaging our services, you agree to be bound by these Terms.

2. Definitions

  • "Goods" means hydraulic components, parts, and related products supplied by us.
  • "Services" means repair, maintenance, component sourcing, and related services provided by us.
  • "Order" means your request to purchase Goods or Services from us.

3. Orders and Acceptance

All orders are subject to our acceptance. We may refuse or cancel an order at our discretion. An order is accepted when we confirm it in writing or commence work. All parts are supplied subject to these Terms.

4. Pricing and Payment

4.1 Pricing

All prices are quoted in South African Rand (ZAR) unless otherwise stated. Prices may change without notice, and we reserve the right to correct pricing errors.

4.2 Payment Terms

Payment terms will be agreed upon at the time of order. Standard payment terms may include:

  • Payment on delivery or collection
  • Payment within 30 days of invoice date (for approved accounts)
  • Deposit required before commencement of work

4.3 Late Payment

If payment is not received by the due date, we may charge interest on the outstanding amount and suspend further services until payment is received.

5. Delivery and Collection

Delivery times are estimates only and not guaranteed. We are not liable for delays beyond our reasonable control. Risk passes to you upon delivery or collection, whichever occurs first.

You are responsible for inspecting goods on delivery/collection and notifying us of any defects or damage within a reasonable time.

6. Repair Services

6.1 Assessment

We will provide an assessment report including any wear, failure, and possible cause of failure along with our repair quotation. Work will commence on receipt of your official works order.

6.2 Repair Standards

All repairs are performed to Original Equipment Manufacturer (OEM) specifications. We will repair, reassemble, and test units to ensure they meet OEM standards.

6.3 Warranty

Repairs are warranted against defects in workmanship for the period stated at the time of repair. The warranty does not cover damage caused by misuse, improper installation, or normal wear and tear.

7. Component Sourcing

We use our extensive technical knowledge and relationships with leading manufacturers to procure hydraulic components at competitive prices. Lead times and availability are subject to supplier constraints and will be communicated at the time of enquiry.

8. Returns and Refunds

Returns are accepted only with prior written authorisation. Goods must be returned unused, in original condition, and in original packaging where applicable. Custom or specially ordered items may not be returnable.

Refunds, if applicable, will be processed within 30 days of receipt, subject to inspection and approval.

9. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the value of the Goods or Services supplied. We are not liable for any indirect, consequential, or special damages arising from the use or inability to use our Goods or Services.

10. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, strikes, supplier failures, or government actions.

11. Governing Law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts of South Africa.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the modified Terms.
